Adjustment of the investment certificate is a process that investors must carry out at the investment registration agency when there are changes related to the investment project and the information on the investment certificate. - The adjusted information must be accurate, complete and legal in accordance with the provisions of law
- The investor does not violate the contents specified in the issued investment registration certificate
- A written request for adjustment of the investment project (according to the prescribed form)
- Report on the implementation of the project up to the time of adjustment
- The investor's decision on the adjustment of the investment certificate for institutional investors
- Explaining or providing documents related to the adjustment of the contents of the investment project
- Financial statements for the last 2 years or related financial commitments
- Investment registration certificate (certified copy) - A written authorization for another individual or organization to carry out the adjustment procedures (if any)
4.1 Contents to be noted when preparing adjustment documents
- Documents to be prepared must be complete, accurate and in accordance with the provisions of law
- Documents issued in Vietnam need to be notarized; documents issued abroad must be consular legalized and translated into Vietnamese
4.2 Form of application for adjustment
- Download the form of written request for adjustment of the investment project
5.1 Adjustment of investment projects not subject to approval of guidelines
- The investor submits 01 set of dossier at the competent investment agency
- Within 10 working days from the date of receipt of a valid dossier, the investment registration certificate shall be adjusted
5.2 Adjustment of investment projects subject to approval of guidelines Prime Minister-level competence
- Submit 08 sets of dossiers at the Ministry of Planning and Investment
- Within 63 working days, the investment registration certificate shall be adjusted Competence of provincial-level People's Committees
- Submit 04 sets of dossier at the Department of Planning and Investment
- Within 55 working days, the investment registration certificate shall be adjusted Competence to grant management boards of industrial parks, export processing zones, hi-tech parks and economic zones
- Submit 04 sets of dossiers at the relevant Management Board
- Within 48 working days, the investment registration certificate shall be adjusted
5.3 Competence to adjust investment certificates
- Management boards of industrial parks, export processing zones, hi-tech parks and economic zones shall adjust projects in their management areas
- The Department of Planning and Investment adjusts projects outside the above area
- The investment registration agency where the project is implemented or where the executive office is expected to be located
