Employees have the right to file a lawsuit at the District Court when they perceive that their legitimate rights and interests have been violated. Some types of labor contract disputes are not required to go through conciliation procedures and can be filed directly in court, including:


- Handling labor discipline (such as dismissal) or unilateral termination of the labor contract.

- Compensation for damages and benefits upon termination of employment contracts.

- Disputes between domestic workers and employers.

- Issues related to social insurance, health insurance, unemployment insurance, and occupational accident insurance.

- Compensation for damages between employees and enterprises sending employees to work abroad.

- Disputes between rehired employees and rehired employers.


3. Statute of Limitations for Filing a Lawsuit and Resolution Time

3.1. Statute of Limitations for Filing a Lawsuit


The statute of limitations for filing a lawsuit for labor contract disputes is 01 year from the date of discovery of the violation of legitimate rights and interests.


3.2. Resolution Time at Court


- Time limit for preparing for first-instance trial: 02 months from the date of acceptance of the case. For complicated cases or cases due to objective obstacles, the time limit may be extended by 01 month.

- Time limit for opening a trial: 01 month from the date of the decision to bring the case to trial at first instance. In case of legitimate reasons, this time limit may be extended to 02 months.


4. Dispute Resolution Procedure at Court

4.1. Step 1: Submitting a Petition


The plaintiff must prepare a petition with documents proving the infringed legal rights and interests and send it to the competent Court in the following forms:


- Submit directly at the Court.

- Send by post.

- Send online via the Court's electronic information portal (if available).


4.2. Step 2: Pay the Advance Court Fee


The plaintiff is obliged to pay the advance court fee, except in some cases such as:


- Salary.

- Unemployment allowance, severance allowance.

- Social insurance.

- Compensation for work-related accidents and occupational diseases.

- Settling compensation for damages or illegal dismissal.


4.3. Step 3: Preparing for Trial and Mediation


- Mediation: During the preparation period for the first instance trial, the Court will conduct mediation. If the mediation is successful, the Judge will issue a decision recognizing the agreement. This decision takes effect immediately and is not subject to appeal.

- Bringing the Case to Trial: If the mediation is unsuccessful, the case will be brought to trial at first instance after the trial preparation period expires.
